Agreement to Terms

By accessing and using the services of Rooten Johns Creek Tree Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or website.

Services Provided

Rooten Johns Creek Tree Service provides professional tree care services including tree removal, trimming and pruning, stump grinding, emergency tree services, land clearing, tree health maintenance, arborist consulting, and shrub and hedge trimming. All services are performed by trained professionals in accordance with industry standards.

Estimates and Pricing

We provide free estimates for our services. Estimates are based on site conditions at the time of inspection and may be subject to change if conditions differ significantly when work begins. Final pricing will be confirmed before work commences. Payment is due upon completion of services unless other arrangements have been made in writing.

Property Access and Permissions

Clients are responsible for ensuring we have legal authority to perform work on the property and for obtaining any necessary permits or approvals from local authorities, homeowners associations, or other governing bodies. Clients must provide clear access to work areas and notify us of any underground utilities, irrigation systems, or other obstacles that may affect our work.

Liability and Insurance

Rooten Johns Creek Tree Service carries appropriate liability insurance and workers compensation coverage. We are not responsible for damage to underground utilities, irrigation systems, or other hidden obstacles not identified before work begins. Clients are responsible for marking or identifying such features. We are not liable for damage to lawns, landscaping, or other property features that may be unavoidably affected during tree service operations.

Cancellations and Rescheduling

We understand that circumstances change. Please provide at least 24 hours notice if you need to cancel or reschedule services. Emergency services may have different cancellation policies. We reserve the right to reschedule work due to weather conditions, equipment issues, or other circumstances beyond our control.

Warranty and Guarantees

We guarantee our workmanship and will address any issues arising from improper technique or execution. However, we cannot guarantee the survival or health of trees following pruning or other treatments, as many factors beyond our control affect tree health. We are not responsible for tree failure or decline due to pre-existing conditions, environmental stress, or factors unrelated to our services.

Limitation of Liability

Our liability for any claim arising from our services is limited to the amount paid for those specific services. We are not liable for indirect, incidental, or consequential damages. Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.

Dispute Resolution

Any disputes arising from these terms or our services will be resolved through good faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in Fulton County, Georgia, in accordance with the rules of the American Arbitration Association.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
